We collected 6,700.00 from this job in 08 so it does matter to me. I would’nt die if I lost it but there goes my new DI rig L We are there on a monthly basis with the amount of work changing every time.
He is connected to other stores that I service but I do not have all the chain stores in my area. The managers decide who they want. But I’m sure it would not help for him to stir the pot with the other managers. (he seemed not at all interested when I stated that the other stores in his franchise sign it.
I guess what really bugs me is if you look on his stores invoices it says the same thing different wording but the same message. And when I asked him if I just copied his of his invoice would he sign it???? He said nope
So I will probably just try to keep him happy on case by case basis. Be if he get 30 days behind I will refuse service till his account is current.

How much is the account? That is the big question. If it is $10.00 or $100.00 not a big risk.
If it is $5,000 or something and you are not prepared to lose it, he needs to sign something that is agreeable to both of you or pay C.O.D or under 30 days or something.
It looks like a red flag to me. I would be wary, he may be just the person you had the clause written for and he knows it.

Assuming the worst: that you do a bad job and insist on being paid, then it would be offensive to him to have to pay your legal fees to be sued. Perhaps he would agree to paying legal fees only in the event that he loses in court. Is this a big customer or a small one? You say orders (plural) so this has happened before? Has he been a problem in the past? If you're talking about just a couple hundred dollars per cleaning I would take out the clause because it isn't worth pursuing with an attorney anyway.

I’m just looking for a few pointers on how to approach this situation.
I have a ONE customer that refuses to sign my work orders because I have this written on it.
All work to be completed in a professional manner according to standard practices. Any alteration or deviation from above specifications involving extra costs will be executed only upon written orders and will become an extra charge over and above the estimate. All Complaints and concerns must be brought to our attention within 24 hours of the completion of the job. All agreements are contingent upon delays beyond our control. Purchaser agrees to pay all costs of collection, including attorney's fees.
Is this not standard to ask them to sign a work order saying, if you are happy with the service then you have to pay your bill and if you don’t. I will sue and you will pay for me to collect my money.
All my other customers have no problems signing this but I’m not sure they have all read it as carefully as he did.
Any pointers????
